Here is a short example of what the generator produces for an injury claim. Your letter will use your own details.

RE: Demand for settlement of bodily injury claim. On March 3, 2026, I was stopped at a red light at Main Street and 5th Avenue in Austin, Texas, when your insured struck the rear of my car. The police report lists your insured as at fault for following too closely. I was taken to City Hospital, diagnosed with a neck sprain and lower back strain, and completed 12 weeks of physical therapy. My medical expenses total $7,230 and I lost $2,700 in wages. For about three months I could not lift my children, drive more than short distances or sleep through the night. To resolve this claim, I am requesting $32,000. Please respond in writing within 30 days of the date of this letter.

Sample diminished value letter

RE: Demand for payment of diminished value. My 2022 Toyota RAV4 XLE was struck by your insured on March 3, 2026. The car was repaired at a certified shop, but it now carries an accident on its history report. Before the collision it was worth about $31,500. Based on an independent appraisal, which is enclosed, its value after repair is $27,800. I am requesting $3,700 for the diminished value of my vehicle. Please respond within 30 days.

What goes into a strong demand letter

  1. The basics up front. Your name, the claim number, the insurer's policyholder and the date of the crash. It saves the adjuster time and keeps your letter from getting lost.
  2. Facts, not feelings. Where you were, what the other driver did, what the police report says. Keep it short and specific.
  3. Your injuries and treatment, in the order they happened: ER visit, diagnosis, therapy, follow ups.
  4. An itemized list of damages. Every bill, with the provider and amount. Adjusters check the math, so make it easy.
  5. A clear number. Name the amount you are asking for. It is normal to open higher than you expect to settle.
  6. A deadline. Thirty days is common. It shows you are organized without being aggressive.

How much should you ask for?

Avoid asking for more than the other driver's policy limit unless you have a plan for the difference, like an underinsured motorist claim with your own insurer. Asking for an amount the policy cannot pay rarely speeds things up.

Mistakes that weaken a demand letter

  • Admitting fault or apologizing for the crash. Stick to what happened.
  • Guessing about injuries you have not been diagnosed with.
  • Leaving out small costs. Parking at the hospital, prescriptions and mileage to appointments add up.
  • Sending original documents. Always send copies.
  • Missing the deadline in your state. A demand letter does not pause the statute of limitations.

After you send your letter

  1. Write down the date you sent it and how.
  2. Expect an acknowledgment and then a response, often within about 30 days.
  3. If the response is a lower offer, ask for the breakdown in writing.
  4. Reply in writing with any missing documents and your counteroffer.
  5. Before accepting, check what you would really keep with the take-home calculator and read should you accept the first settlement offer.

Tone matters

Adjusters read letters all day. A calm, organized letter that sticks to facts, lists numbers clearly and asks for a specific amount is more effective than an angry one. You can be firm without being hostile. If you are frustrated, write the letter, wait a day, and read it again before sending.
